Case Summary
The defendant was alleged to have brutally assaulted British POWs on many occasions, in particular striking the victim, Major Richardson, repeatedly on the face with his fist, as a result of which the latter sustained a fractured jaw and some broken teeth. The defendant was charged with the ill-treatment of British POWs and causing bodily injury and suffering to Major Richardson.

A plate of photographs was provided to witnesses for them to identify the accused. The defence counsel argued that the case should have been dismissed because the defendant had been mistakenly identified based on these photographs, and because of inconsistent evidence.
